Zambales mayor Marty convicted over non-issuance of permits
Sta. Cruz, Zambales Mayor Luisito Marty has been found guilty of graft and usurpation of legislative powers for not issuing business permits to two mining firms.
Because of this, the Sandiganbayan 3rd Division sentenced Marty to imprisonment ranging from six years and one month imprisonment up to maximum 10 years for graft.
For the crime of usurpation, Marty also got an additional prison term ranging from four months and 21 days up to six months and one day.
The anti-graft court also ordered him to pay a fine of P50,000.
The case stemmed from Marty’s refusal back in 2011 to issue business permits to Zambales Diversified Metals Corporation Inc. (ZDMC) and Zambales Chromite Mining Company Inc. (ZCMC) without any legal basis considering they already complied with all the requirements prescribed by law.
The court pointed out he made “the feeble excuse that the approval or denial thereof is dependent upon the reply of the Mines and Geosciences Bureau (MGB) to his alleged letter regarding his request for clarification on ‘various mining issues affecting the municipality of Sta. Cruz, Zambales, particularly environmental tax.”
The 3rd Division ruled on Marty’s demurrer to evidence which challenged the evidence presented by the prosecution during the trial.
